Statement of an engineer

From September 21, 2011, a statement of an engineer is mandatory for every judicial act inter vivos in accordance with paragraph 4 of article 23 of Hellenic Law 4014/2011.

Hellenic Law 4014/2011 stipulates that every judicial act inter vivos that is drawn up and that concerns the transfer or establishment of a right in rem on a property must be accompanied by a statutory declaration of the owner and by a statement of an engineer in which the owner and engineer, respectively, shall state and confirm that no illegal constructions have been erected on the property that affect the height of the property, the structuralisation and the coverage and height of the building and that no uses have been installed without a permit and that any existing illegal constructions or illegal uses come under one of the exceptions that are provided for under paragraph 2 of article 23 of Hellenic Law 4014/2011, as well as that no other illegal construction has been erected and no other illegal use has been installed according to the approved town plans and do not come under any of the cases that are provided for under paragraph 3 of article 23 of Hellenic Law 4014/2011.

An engineer requires the following documents in order to issue his statement:
1.Copy of the building permit.
2. Topographic diagram.
3. Approved plans.
4. Deeds of ownership.
5. All legalising documents in the case of illegal constructions or uses.

The statement of an engineer is also required for the transfer of lots and fields. In the case of a transfer of a lot or field, the statement must note that no structure has been erected on the lot. If a statement of an engineer is not attached in the case of a transfer of a lot, a sentence of imprisonment of at least six (6) months and a monetary fine of €30,000 to €100,000 is imposed on all parties involved.The statement of an engineer is valid for two (2) months.

The engineer’s fee for issuing the statement that is provided for under Hellenic Law 4014/211 is subject to the services that the engineer shall provide for the issue of the statement.
